MURRAY MAIN STREET/THE MURRAY BANK ICE SKATING RINK WAIVER/RELEASE
Buy Purchasing tickets, you agree to the release below
I have purchased a ticket for myself or my child to ice skate in downtown Murray, Kentucky. I understand that purchasing this ticket enables me or my child to skate for one session (45 minutes).
In consideration of being permitted to utilize the Murray Bank Ice Skating Rink at Murray, Kentucky, and in consideration of the benefits received by me as a result of said use, I, together with my heirs, executors, administrators, and assigns, hereby release, waive, and forever discharge and covenant not to sue Murray Main Street, The Murray Bank, the City of Murray, Heart Breaker Entertainment, it’s sponsors, and all their officers, agents, members, employees, full or part-time, insurers, lessees, lessors, and associates of any status whatsoever, all for the purpose herein referred to as Releasees, from all liability to me, my child, my children, and person that I am a guardian of, my heirs, executors, administrators, and assigns for all loss or damage, and any claim or damage therefore, on account of injury or death to my person, my child, my children, any person that I am a guardian of, or property, whether caused by the negligence of Releasees or otherwise while I am utilizing the above described ice skating rink facilities and/or observing any ice skating and/or related event being held in Murray, Kentucky.
I hereby further agree to indemnify and to hold forever harmless the said Releasees from any and all claims, loss, liability, damage or cost Releasees may incur due to my presence in Murray, Kentucky, while utilizing the above-described ice skating rink facilities, and/or participating in and/or observing said ice skating and/or events.
I hereby assume all responsibility for and risk of bodily injury, death, or property damage due to any act or omission of Releasees while so utilizing the above described ice skating rink facilities and/or participating in and/or observing said ice skating rink and/or events.
I expressly agree that this release, waiver and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of Kentucky and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and legal effect.
I, being of lawful age, in consideration of being permitted to utilize the above described ice skating rink facilities and/or participate in and/or observe the ice skating rink and/or events in Murray, Kentucky, release and forever discharge Releasees, their heirs, administrators, and executors of and from any and every claim, demand, action, of whatsoever kind or nature, either in law or in equity arising from or by reason of any bodily injury or personal injuries known or unknown, death, and/or property damage which may occur as a result of my utilization of the above described ice skating rinks facilities and/or any participation in and/or observation of ice skating and/or events in Murray, Kentucky or any activity in connection therewith, whether by negligence or not.
